Referral Program Regulations for "Quizonator"

§1. General Provisions
This Regulation (hereinafter referred to as the "Regulation") sets out the rules, conditions and procedure for participating in the referral program called "Quizonator" (hereinafter referred to as the "Program"), organized and conducted by the Organizer, as well as the rights and obligations of the Organizer and the Participants of the Program (hereinafter referred to as the "Promoters"). The Regulation also constitutes the terms and conditions for the provision of electronic services within the meaning of the Act of 18 July 2002 on the provision of electronic services (consolidated text: Journal of Laws of 2020, item 344, as amended). The Organizer of the Program is QUIZONATOR SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ, a Polish company with its registered office at ul. Św. Mikołaja 8/11 / 208, 50-125 Wrocław, Poland, entered in the National Court Register kept by the District Court for Wrocław-Fabryczna in Wrocław, VI Economic Division of the National Court Register, under the number KRS: 0001149825, having the tax identification number NIP: 8971947982 and the REGON number: 540680867 (hereinafter referred to as the "Organizer"). The Regulation is publicly available and free of charge on the Organizer's website at: https://quizonator.com/referral-program in a manner that allows it to be downloaded, recorded and printed. The Organizer declares that the Program is not a game of chance, a lottery, a mutual bet, a promotional lottery or any other form of gambling within the meaning of the Act of 19 November 2009 on gambling (consolidated text: Journal of Laws of 2023, item 227). The aim of the Program is to encourage the promotion of services provided by the Organizer through a system of recommendations resulting in increased sales of these services. The Program is implemented on the territory of the Republic of Poland through the Internet, in particular using the Organizer's website and e-mail.
§2. Definitions
Regulation - this document setting out the rules and conditions for participating in the Program. Program - the referral program "Quizonator", organized and conducted by the Organizer on the terms set out in this Regulation. Organizer - QUIZONATOR SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ, as defined in §1 para. 2 of the Regulation. Promoter - an adult natural person with full legal capacity, residing in the territory of the Republic of Poland, who has joined the Program on the terms set out in the Regulation. Recommendation - an action of the Promoter consisting in the effective recommendation of the Organizer's services, which leads to the conclusion of a sales contract for these services through the unique referral link assigned to the Promoter. Top 10 Promoters - a group of Promoters who in a given calendar month have achieved the highest results in the number of accumulated points for effective Recommendations, in accordance with the rules set out in §5 of the Regulation. Commission - a cash reward paid to Promoters from the Top 10 group, calculated as a specified percentage of the net value of sales generated by their Recommendations in a given month, in accordance with §6 of the Regulation. GDPR - Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC.
§3. Conditions of participation
Only an adult natural person with full legal capacity, residing in the territory of the Republic of Poland, who meets the conditions set out in the Regulation, may participate in the Program (Promoter). The following persons are excluded from participating in the Program: - employees of the Organizer employed on the basis of an employment contract, a contract of mandate, a contract for a specific task or another legal relationship, - members of the management bodies of the Organizer, including members of the management board, - persons belonging to the immediate family of the persons referred to in points a) and b) above, i.e. spouses, children, parents, siblings, relatives and in-laws to the second degree of kinship or affinity, as well as persons in a relationship of adoption, - persons associated with entities providing services to the Organizer in connection with the preparation, organization or conduct of the Program. The condition for joining the Program is: - familiarization with the content of the Regulation and consent to its provisions, - registration in the Program by completing the registration form available on the Organizer's website at: https://quizonator.com/earn, in which the Promoter provides his/her e-mail address and consents to the processing of personal data for the purposes of the Program. Participation in the Program is completely voluntary and free of charge. The Promoter has the right to resign from participating in the Program at any time by sending a written statement of resignation to the Organizer's e-mail address: support@quizonator.com. The resignation becomes effective upon receipt of the statement by the Organizer. The Organizer reserves the right to exclude the Promoter from the Program if it finds that: - the Promoter has violated the provisions of the Regulation, - the Promoter has acted in a manner contrary to the generally applicable laws, - the Promoter has taken actions aimed at manipulating the results of the Program, including generating false Recommendations. The Organizer notifies the Promoter of the exclusion from the Program by e-mail sent to the address provided during registration. The decision to exclude is final, which does not exclude the Promoter's right to pursue claims in court in accordance with the generally applicable laws.
§4. Duration of the Program
The Program starts on January 1, 2025 at 00:01 Polish time and lasts until May 31, 2025 at 23:59 Polish time, unless the Organizer decides to extend or terminate it earlier. The Organizer will inform about the start of the Program on its website at: https://quizonator.com/ with at least 7 days' notice. The Organizer reserves the right to terminate the Program before the originally planned date for valid reasons, such as a change in the law or a business decision of the Organizer, about which the Promoters will be informed at least 14 days in advance by e-mail.
§5. Rules for earning points
After registering in the Program, the Promoter receives a unique referral link, which can be used to recommend the Organizer's services. For each effective Recommendation, understood as the conclusion of a purchase of the Organizer's services by a third party through the Promoter's unique referral link, the Promoter receives points according to the following system: - 10 points - for the purchase of a monthly subscription by the referred user, - 50 points - for the purchase of a semester subscription by the referred user, - 5 points - for the purchase of a small answer package, - 20 points - for the purchase of a medium answer package, - 40 points - for the purchase of a large answer package. Points are awarded based on the type of purchased product, regardless of its monetary value, with one purchase corresponding to one point assignment. At the end of each calendar month, the Organizer establishes the Top 10 Promoters ranking, i.e. the Promoters who in a given month have accumulated the highest number of points for effective Recommendations. In the event of two or more Promoters achieving the same number of points, the order in the ranking is determined by the date and time of the first Recommendation registered in a given month - the higher place is taken by the Promoter who first achieved the given number of points. Points accumulated in a given month are not transferred to the next month and are reset on the 1st day of each subsequent calendar month at 00:01 Polish time.
§6. Commissions for Top 10 Promoters
Promoters qualified for the Top 10 group in a given calendar month receive a Commission for each sale of the Organizer's services made through their unique referral links in that month. The amount of the Commission depends on the place occupied in the Top 10 ranking and is: - 1st place: 15% of the net value of sales generated by the Promoter's Recommendations, - 2nd place: 12% of the net value of sales generated by the Promoter's Recommendations, - 3rd place: 10% of the net value of sales generated by the Promoter's Recommendations, - 4th-10th place: 8% of the net value of sales generated by the Promoter's Recommendations. The Commission is calculated based on the net value of sales (excluding VAT) generated in a given calendar month, in which the Promoter found himself in the Top 10. The Commission is due only for sales made in the month in which the Promoter qualified for the Top 10, and does not cover sales from other periods.
§7. Commission payment process
Notification of Promoters: Within 7 working days from the end of the calendar month, the Organizer sends an e-mail to the address provided by the Promoter during registration, informing about the qualification for the Top 10 and calling for the submission of data necessary for the payment of the Commission. Required data for payment: - the name and surname of the Promoter, - bank account number in IBAN format, - address of residence (for tax and verification purposes), - tax identification number NIP (in the case of Promoters conducting business activity). Promoters from the Top 10 are required to provide the data referred to in para. 2 above, within 5 working days from the date of receipt of the e-mail from the Organizer. Failure to provide the data within this period results in the loss of the right to the Commission for a given month. Payment deadline: The Commission is paid by bank transfer to the Promoter's designated account no later than the last working day of the month following the month in which the sale was made. Additional contact attempts: In the event of no response to the first e-mail within 5 working days, the Organizer makes two further contact attempts at intervals of at least 3 working days. If, despite 2 attempts, the Promoter does not provide the data, he loses the right to the Commission for a given month, and the unpaid amount is not transferred to other periods. Organizer's liability: The Organizer is not responsible for delays in the payment of the Commission resulting from the provision by the Promoter of incorrect or incomplete bank details or for reasons beyond the control of the Organizer, such as failures of bank systems. The Commission is paid only to the Promoter's bank account specified in the data provided to the Organizer and cannot be transferred to third parties.
§8. Tax obligations
The Organizer, as the payer, pays an advance on the personal income tax on the paid Commission in accordance with the provisions of the Act of 26 July 1991 on personal income tax (consolidated text: Journal of Laws of 2023, item 151, as amended). Promoters will receive from the Organizer a PIT-11 form for the tax year in which the Commission was paid, within the time limit provided for by the law. Promoters conducting business activity are required to issue an invoice or bill to the Organizer for the received Commission, in accordance with the applicable tax regulations, within 7 days from the payment of the Commission. The Organizer is not responsible for the individual tax settlements of the Promoters, except for the obligations arising from the role of the payer specified in the generally applicable laws.
§9. Personal data protection
The Administrator of the Promoters' personal data within the meaning of the GDPR is the Organizer, i.e. QUIZONATOR SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ. The personal data of the Promoters (in particular: e-mail address, name and surname, IBAN number, address of residence, NIP) are processed for the following purposes: - implementation of the Program, including verification of Recommendations and payment of the Commission (legal basis: art. 6 para. 1 lit. b GDPR - performance of the contract), - fulfillment of legal obligations, including tax and accounting obligations (legal basis: art. 6 para. 1 lit. c GDPR - legal obligation), - implementation of the legitimate interests of the Organizer, such as the pursuit or defense against claims (legal basis: art. 6 para. 1 lit. f GDPR). Providing personal data is voluntary, but necessary to participate in the Program and receive the Commission. The personal data of the Promoters will be stored for the duration of the Program, and after its termination for a period of 5 years from the end of the calendar year in which the Program ended, in accordance with the requirements of tax law, or until the expiration of any claims related to the Program, depending on which period is longer. The personal data of the Promoters may be transferred to: - entities providing services to the Organizer, such as IT service providers, banks carrying out transfers, law firms or accounting offices, only to the extent necessary to implement the Program, - public authorities, including tax offices, on the basis of applicable law.

§10. Complaint procedure
Promoters have the right to submit complaints regarding the implementation of the Program within 30 calendar days from the date of the event that is the basis of the complaint. Complaints can be submitted: - in writing to the registered office of the Organizer: QUIZONATOR SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ, ul. Św. Mikołaja 8/11 / 208, 50-125 Wrocław, Poland, with the note "Complaint - Quizonator", - in electronic form to the e-mail address: support@quizonator.com, with the subject "Complaint - Quizonator". The complaint should contain: - the name and surname of the Promoter, - address of residence or e-mail address for correspondence, - a detailed description of the event that is the basis of the complaint, - the date of the event, - the Promoter's expectations regarding the resolution of the complaint. The Organizer will consider the complaint within 14 calendar days from the date of its receipt and inform the Promoter of the outcome of the consideration in a manner corresponding to the manner of submitting the complaint (in writing or electronically). The decision of the Organizer in the complaint procedure is final within the Program, which does not exclude the right of the Promoter to pursue claims in court in accordance with the provisions of the law.
§11. Changes in the Regulation
The Organizer reserves the right to make changes to the Regulation for valid reasons, such as: - a change in the generally applicable laws affecting the implementation of the Program, - adaptation of the Program's rules to new products or services of the Organizer, - a change in the amount of the Commission or the rules for its awarding, - the need to clarify the provisions of the Regulation in order to remove ambiguities. Changes in the Regulation come into force after 7 calendar days from the date of their publication on the Organizer's website at: https://quizonator.com/. The Promoters will be notified of any changes to the Regulation by e-mail to the address provided during registration, with at least 7 days' notice. Promoters may resign from participating in the Program before the changes to the Regulation come into force by sending a relevant statement to the address: support@quizonator.com. Failure to resign within this period means acceptance of the changed Regulation.
§12. Transparency and communication
The Organizer undertakes to ensure Promoters full transparency in the scope of the results of their Recommendations and the points awarded. Promoters will receive monthly reports containing information about: - the number of effective Recommendations in a given month, - the number of accumulated points, - the value of sales generated through their referral links. The reports will be sent to the Promoter's e-mail address or made available in the user panel on the Organizer's website at: https://quizonator.com/promoter-panel. The Organizer guarantees that the data presented in the reports is consistent with the actual state of affairs and is subject to verification at the request of the Promoter.
§13. Final Provisions
In matters not regulated by this Regulation, the provisions of the generally applicable Polish law shall apply, in particular the Act of April 23, 1964 - Civil Code (uniform text: Journal of Laws of 2023, item 1610, as amended). All disputes arising from the implementation of the Program or related to its interpretation shall be resolved by the common court competent for the seat of the Organizer, i.e. for the city of Wrocław. Contact with the Organizer regarding matters related to the Program is possible only through electronic mail at: support@quizonator.com. The Regulation enters into force on the day of its publication on the Organizer's website and applies throughout the duration of the Program, subject to the possibility of its change in accordance with §11.
