Terms of Service for the "Quizonator" Extension

1. General Provisions
1.1. These Terms of Service define the rules for using the "Quizonator" extension (hereinafter: "Extension"), available for the Chrome browser. 1.2. The Extension is owned by QUIZONATOR Sp. z o.o., headquartered at ul. Św. Mikołaja 8/11/208, 50-125 Wrocław, NIP: 8971947982, REGON: 540680867, registered in the National Court Register under number 0001149825 (hereinafter: "Provider"). 1.3. Using the Extension constitutes acceptance of these Terms of Service. If the user does not accept the Terms, they must cease using the Extension. 1.4. The Extension supports the learning process by analyzing question content and suggesting answers based on ChatGPT analysis, but it must not be used in a way that violates academic integrity rules.
2. Registration and User Account
2.1. To access the full functionality of the Extension, users must register an account by providing an email address, username, and password. 2.2. User accounts are intended for individual use only. Sharing login credentials with third parties is prohibited. 2.3. The Provider reserves the right to block an account in the event of misuse, unauthorized access, or violation of these Terms of Service. 2.4. Users must update their account information in case of changes to ensure the accuracy and currency of their details.
3. Rules for Using the Extension
3.1. Users agree to use the Extension in compliance with applicable laws, these Terms of Service, and principles of social conduct. 3.2. The Provider reserves the right to block a user's account in the following cases: - Violation of these Terms of Service; - Detection of activities that may compromise the system or other users' security; - Engaging in actions that disrupt the operation of the Extension. 3.3. Users will be notified via email if their account is blocked. 3.4. Use of the Extension relies on a credit-based system (referred to as "credits" or "available answers"), which is required to access the Extension's features. 3.5. Credits: - Are provided as part of a purchased subscription plan or via additional credit packages; - Expire at the end of the subscription period if unused; - Are displayed in the Extension's interface, where users can check their remaining balance; - Are non-refundable, except in cases of technical errors preventing their use. 3.6. After all credits are used: - The Extension's features will cease to function until additional credit packages are purchased or the subscription is renewed; - Users will be notified of the option to purchase additional credits through microtransactions. 3.7. Purchasing additional credit packages: - Is possible at any time after using the credits provided by the subscription; - Is independent of subscription renewal but subject to validity terms specified at purchase. 3.8. Each new user is entitled to a free trial period upon account creation and email confirmation. 3.9. Promotional trial period: - The promotion is valid until January 24, 2025; - Users receive 1,000 credits as part of the promotion; - The trial period automatically ends on January 24, 2025, regardless of the start date; - Unused credits will be reset at the end of the promotion, and further use of the Extension will require a subscription or additional credit packages; - The trial period is one-time and available only under this special offer. 3.10. After the trial period or after using all allocated credits: - Users will not be able to use the Extension's features unless they purchase a subscription or additional credit packages. 3.11. The free trial period is limited to one per user account. Creating multiple accounts to gain additional trial periods is prohibited. 3.12. Users are fully responsible for monitoring their credit balance and renewing subscriptions or purchasing credits on time. 3.13. Order processing time: Access to the Extension and purchased credits/subscriptions is granted immediately upon payment confirmation. In case of technical issues, users will be notified of possible delays, and the Provider will strive to resolve them promptly.
4. Provider's Responsibility
4.1. The Provider is not responsible for how users utilize the Extension or for damages resulting from improper use. 4.2. The Provider does not guarantee the accuracy or completeness of answers generated by ChatGPT. 4.3. The Provider is not responsible for copyright or other third-party rights violations committed by users. 4.4. The Provider is not liable for temporary unavailability of the Extension due to maintenance work or factors beyond the Provider's control (e.g., server failures).
5. Copyright and Intellectual Property
5.1. All copyright and intellectual property rights to the Extension belong to the Provider. 5.2. Content generated through the Extension may be subject to third-party copyrights. Users agree to use it in compliance with applicable laws. 5.3. Copying, modifying, distributing, or commercially exploiting the Extension or any of its parts without the Provider's consent is prohibited.
6. Account Blocking
6.1. The Provider reserves the right to block a user's account in cases of: - Violation of these Terms of Service; - Detection of actions that may compromise the system or other users' security; - Actions disrupting the Extension's functionality. 6.2. Users will be notified via email if their account is blocked. 6.3. Refunds: Refunds for unused credits/subscriptions are not available, except in cases where users were unable to use them due to technical errors attributable to the Provider. In the event of a valid complaint, the Provider may issue a full or proportional refund based on the value of unused credits/subscriptions.
7. Personal Data Protection
7.1. Detailed rules for processing users' personal data are outlined in the Privacy Policy available on the Extension's website.
8. Changes to the Terms of Service
8.1. The Provider reserves the right to amend these Terms of Service. 8.2. Users will be informed of changes at least 30 days in advance via publication of the new version on the Extension's website. 8.3. Continued use of the Extension after changes to the Terms of Service implies acceptance of the updated version.
9. Final Provisions
9.1. Matters not regulated by these Terms of Service are subject to applicable Polish laws. 9.2. Any disputes will be resolved by the common courts with jurisdiction over the Provider's registered office.
